TERMS AND CONDITIONS

GENERAL
1.1   These terms and conditions ("Terms") explain your rights and obligations in relation to this web site located at www.clearlinecanvas.co.uk ("Site") and any goods purchased through this Site. Please read them carefully. You may have other rights granted by law and these Terms do not affect these. If there is anything you do not understand then please contact us.
1.2.   This Site is operated by Clearline Canvas ("we", "our" or "us"), located at The Studio, Burrard Grove, Lymington, Hampshire SO41 3QR.  You can telephone us on 01590 670011 and email us at info@clearlinecanvas.co.uk.
1.3   We may change the Terms at any time by posting such changes on the Site. Your continued use of the Site after notice of changes shall mean you are bound by the new terms.

SITE USE
2.1.   The content of and copyright in the Site is owned by or licensed to us. You are permitted to view or print individual pages for your own personal use. Any other use must be with our prior written permission.
2.2.   We reserve the right to suspend, restrict or terminate your use of this Site at any time.

PURCHASING FROM US
3.1.   The Site and the goods sold through it are subject to change without notice and we reserve the right to improve, alter or modify designs without prior notification. We will inform you of any changes to the advertised goods prior to despatch of such goods.
3.2.   By submitting your order you are offering to buy the goods and allowing us to supply your personal details to a courier for the purposes of supplying goods.
3.3.   We are not obliged to supply the goods to you until we have confirmed that we have accepted your order and received payment in full. Your order will be deemed to have been accepted when we despatch to you the goods which form your order. We may, at our discretion, reject your order.
3.4.   All specifications sizes, photographs, descriptive matter and advertising published by us or contained on our Site are issued only for giving an approximate idea of the goods described in them and colours shown are intended as a guide only. They do not form part of the Terms.
3.5.   Prices are subject to change without prior notification.
3.6.   Products are subject to availability. If a product you have ordered becomes unavailable due to circumstances beyond our control, we will offer to supply substitute goods. If the substitute goods are not required we will not process the order, and notify you.
3.7  As each product is custom made to each customer's order we cannot offer a refund unless the product does not match the order, is faulty, or damaged in transmit.  It is imperative that you inspect the goods at the time of signing for delivery, so that any damage is officially recorded by the courier.
3.8  Due to the differences in the profiles of some of the photographs some canvases may not exactly match the measurements shown and are subject to a 10% margin of error.

PRICING
4.1.   All prices are in British Pounds and include Value Added Tax where applicable.

DELIVERY
5.1.   We aim to despatch goods within 7 - 10 working days from receipt of your payment, and deliver goods to you within 1-5 working day from despatch, depending on whether your location is UK, Europe, USA or international. Once our couriers have collected from us you will be advised by email of the expected delivery date and approximate time you can expect delivery.
All deliveries are sent via an insured, secure courier service. Please ensure that someone is available at your delivery address to accept the goods, as a signature is normally required.
5.2   Note that Clearline Canvas does not charge customs duties on International shipments outside of the EU. If any additional customs charges are incurred during your shipment, they are not calculated or monitored by us nor are they the responsibility of Clearline Canvas. We recommend that you check with your local customs officials or post centre for more information regarding importation taxes/duties that may be applicable to your online order with us.

RETURNS
6.1   To make any returns or exchanges (please read 3.7) please contact us via email, with the details of your order, to inform us of your intentions and the reason why. This must be done within 48 hours of receiving your goods.
6.2   Upon safe receipt by us of the returned goods you can receive a refund (if none of the conditions at 3.7 apply) , as long as goods are returned within 7 working days from the date of delivery. Goods must be returned in their original unused condition and with all packaging intact, as set out in 6.6.
6.3   If the goods delivered to you are faulty or have been damaged in transit, then we will either exchange the goods free of charge, or give you a full refund including delivery costs, providing the goods are returned to us within 7 working days from the date of delivery. A photograph taken (by mobile phone if this is easiest) in front of the delivery driver will expediate any claim.
6.4   We will not accept returns for any non-faulty items after 7 working days have elapsed or for items that have been used. In all circumstances you must contact us as set out in 6.1.
6.5   When returning goods, please ensure that you enclose a copy of your original invoice so that we can identify your consignment on arrival.
For your protection we strongly recommend that you use a recorded delivery service to return goods. Proof of posting is not proof of receipt and all goods remain the responsibility of the customer until they are received by us.
6.6   All goods must be in their original condition and with all packaging intact, as we cannot exchange used goods. Due to the delicate nature of art prints, canvas panels must be wrapped individually, in the same way that you received them, to prevent scratching.
6.7   Following receipt of returned goods as set out above, and notwithstanding 3.7 refunds will be processed within 14 days. Refunds will be credited via the original purchaser's payment method.

CANCELLATION
7.1   Should you wish to cancel any order after making payment, cancellation can only be made via the standard refund process as per Section 6. The order will only be cancelled if no part of the production of your order has been started.  It is therefore recommended that you email us IMMEDIATELY that you wish to cancel the order. Receipt of your email does not oblige us to refund the order, but we will do this in good faith if no production expense has been incurred.
If you cancel payment with your card provider rather than following our refund policy, you will be liable for the fee that the provider charges us. Chargebacks will be thoroughly investigated and if necessary, will be referred to relevant investigative or law enforcement agencies.

COPYRIGHT
8.1   All copyright and intellectual property rights existing in our photographs, designs and products, and in the content of the site are, and will remain, the property of us.
8.2   Any reproduction by any means that is made of any of our photographic images is in strict contravention of copyright.
